Trust & Estate Administration

Protecting the Assets In the Event of Incapacity

An individual does not have to die for a trustee, or guardian and/or conservator to be needed. Illness or aging which causes incapacity can result in the need for someone to help oversee and manage hard-earned assets. As the population continues to age, the need for accurate estate planning and trust and estate administration has increased. At Smith & Mabley in Farmington Hills, Michigan, we help our clients exercise much-needed control and authority to manage the trust or estate of an elderly loved one. If a parent, grandparent or other relative/friend has set up a trust, we can assist them through the process of undertaking their responsibility as trustee, or as attorney in fact under a power of attorney. Even if no planning has been done, we have the experience to help the family navigate through the numerous requirements of Michigan probate law and court rules, in establishing and administering guardianships and conservatorship.

Do not allow a family member to be exploited because they can no longer make decisions about their medical condition or assets. We can help protect them. Contact one of the Trust and Estate Administration lawyers at our firm by calling us toll free at 866-975-9915 or sending us an e-mail.

The Process of Trust Administration

At the time of a trust owner's death, the professional staff at Smith & Mabley, will guide the successor trustee or administrator through the process of transitioning the assets to the named beneficiaries in accordance with the directions contained in the trust agreement. We understand the emotions involved and provide counsel to the trustee in regard to handling the administration of the trust so that all the family members understand and are comfortable with the transition.

The Challenges of Probate Estate Administration

Unfortunately, some individuals do not set up a plan to direct the disposition of their assets. When this occurs, our attorneys and staff can help the family understand and comply with the numerous requirements of the Michigan probate law. Just as one would trust a close friend, we hope you will put your trust in us to assist you and your family members in dealing with the complexities of the probate process.
